Heard on the application filed under Section 378(3) of the Code of Criminal Procedure, 1973 for grant of leave to appeal. 2.

This petition is preferred against order dated 28th September, 2018, passed by Judicial Magistrate First Class, Baloda Bazar(C.G.) in Cr. Complaint Case No. 241/2013, wherein the said court has acquitted the respondent for the charges under Sections 294, 323 and 506 Part II of the I.P.C.

In the present case, name of the complainant is Ajay Kumar who is examined as PW1 before the trial Court, but he did not depose regarding the factum of offence. He simply deposed before the trial court that it was a trivial dispute.

The trial Court after going through the evidence recorded the finding of acquittal of the respondent. After reassessing the

evidence, this Court has no reason to interfere with the finding recorded by the trial Court and it is not a case where the respondent should be called for full consideration of the case. Accordingly, the prayer for leave to appeal is rejected. 5.

Consequently, Cr.M.P. stands dismissed.
