Ms. Akanksha Jain, Dy. GA Hon'ble Shri Justice Goutam Bhaduri Order On Board 04/12/2019

1. Heard.

2. The grievance of the petitioner is that she has been transferred from Primary Health Centre, Hanaud, District Durg to Primary Health Centre, Kiskodo, District Kanker (C.G.) by order dated 19.08.2019 on administrative grounds.

3. It is contended that respondent No.4 Anita Patel has been transferred from

PHC, Kiskodo, District Kanker to PHC, Hanoud, District Durg, on her own expenses and in order to accommodate respondent No.4, the petitioner is being disturbed, therefore, the petitioner cannot be subjected to any discrimination to accommodate some one. It is further contended that the petitioner has filed a representation before the Grievance Redressal Committee and as per the information of the petitioner, the same has been dismissed.

4. The order of the Grievance Redressal Committee has not been placed on record. However, it has been stated that the representation of the petitioner has been rejected. Since the order of transfer is dated 19.08.2019, I do not find any sufficient reason to interfere with the same after such a long time. However, since the medical grounds have been raised to cancel the transfer of the petitioner, the petitioner is given further liberty to make a detailed representation afresh canvasing all the grounds before the respondent No.2 within a period of three weeks from today and on such representation being filed, the same shall be decided within a period of 60 days from the date of receipt of the representation.

5. With the aforesaid observation, the writ petition stands disposed of. Sd/- Goutam Bhaduri Judge Ashu
