The petitioner is facing trial for offences punishable under Sections 356 and 379 of Indian Panel Code and he was arrested on 27/03/2019. The trial could not be concluded within the stipulated time, then the petitioner had filed the application under Section 437(6) of the Cr.P.C. which was rejected by the Learned Trial Magistrate as well as by the Revisional Court against which this petition under Section 482 of the Cr.P.C. has been preferred.

Learned counsel for the petitioner submits that both the Courts below were unjustified in rejecting the application filed under Section 437(6) of the Cr.P.C., therefore, the petitioner be released on bail.

I have heard learned counsel for the petitioner. 4.

Taking into consideration the nature of allegations and the trial court has exercised the discretion properly and in sound manner in rejecting the application under Section 437(6) of the Cr.P.C., I do not consider it a fit case for enlarging the petitioner on bail in exercise of power under Section 437(6) of the Cr.P.C., therefore, both the Courts below are absolutely justified in rejecting the application.

Accordingly, the petition under Section 482 of the Cr.P.C. is hereby dismissed.
