1. The short grievance of the petitioner is that the petitioner is the Haulage Operator in the SECL. A criminal case was registered against the petitioner on 03.07.2019, however, subsequently, he was bailed out on 09.09.2019. Thereafter, he went to report back to the department to join his duties on

16.09.2019, his joining was not accepted and it was rejected.

2. Learned counsel for the petitioner would submit that the SECL may be directed to take a decision on the request of the petitioner and the application of the petitioner for joining as it is contended that till date the petitioner is neither been suspended nor any notice has been served may be directed to be decided.

3. Learned counsel for the SECL would submit that if the application has been given by the petitioner, it will be decided.

4. Considering the fact at this stage no issue falls for consideration except the fact that the petitioner if he has given the application for joining that may be considered and decided by the SECL in accordance with law.
