Hon'ble Shri Justice Goutam Bhaduri Order on Board 06.12.2019 Heard.

1. On perusal of the petition, it appears that this petition is as vague as it could be. On earlier occasion, while hearing was going on, taking into consideration the prayer made at Para 10.2 and looking to the seriousness of the matter, time was granted to the petitioner to clarify that whether the unpaid salary is being paid or not. Having turned back, it is contended that there is no unpaid salary, however, respondent no.4 is now being posted in Khadgaon forest circle wherein the petitioner was holding the charge and if respondent no.4 is allowed to work, the petitioner would be without any work.

2. The prayer of the petitioner like nature cannot be entertained and he cannot be ordered to be placed at a particular place of his own choice. It is the prerogative and choice of the State to allot particular work to particular officers. According to the convenience of the State. The employee cannot have any option to work in a particular office or at a particular table and he cannot demand to discharge a particular job. Accordingly, the petition sans merit and is dismissed.
