The applicant is apprehending his arrest in connection with Crime No.243/2019 registered at police station - Baloda, District Janjgir-Champa (C.G.) for alleged commission of offence under Section 409, 420/34 of IPC. 2.
Prosecution case against the applicant is that the applicant has misappropriated huge amount of Rs.11,47,000/-, which was deposited with the bank for payment to 54 labourers.

Learned counsel for the applicant submits that the allegations are false. He would submit that no amount has been misappropriated by the applicant. He further submits that he was not the concerned person to withdraw the amount. It is also submitted that offence has been registered without verifying from the concerned labourers. 4.
Learned State counsel submits that report was lodged by Mr. Amit Shrivastava, who is Branch Manager of Phino Payment Bank Branch Janjgir, where present applicant was working. The report shows that the amount was withdrawn but no payment has been made.

Considering the submission of learned counsel for the parties, prima facie, in view of report lodged by none other than the Branch Manager himself against the present applicant, present is not a fit case for grant of anticipatory bail.
