1. Heard.

2. The grievance of the petitioner is that the petitioner is transferred from New Government College Hasaud, District Janjgir- Champa to New Government College Baloda, District Janjgir Champa.

It is contended that the petitioner went to join his new place of posting i.e. Baloda but it was found that the post of Lab Technician is not vacant and the Principle, New College Baloda, District Janjgir Champa informed that all the posts are filled up, therefore, the petitioner could not join there. Subsequently, the petitioner made a representation to Secretary that his posting may be made at another place and he further informed that 1 post is already vacant at TCL Agrani College, Janjgir.

4. Perusal of the document would show having transferred to Government New College, Baloda District Janjgir when he went to join their he could not

join because of the fact that the posts were not vacant. Consequently, the Principle wrote a letter to Secretary dated 29.08.2019 and inform no vacant post is available. It is contended further by the petitioner because of the said fact, he could not join new place of posting i.e. at Baloda and consequently he has not been relieved from earlier place of posting i.e. Hasaud.

5. Taking into the fact that the petitioner has already moved a representation (Annexure P-3) to the Secretary, it is directed that the Secretary shall decide the representation of the petitioner within a period of 60 days from the date of presentation of the order and till then status quo as prevailing as on today shall continue.
