1. Heard.

2. It is contended that a punishment order was passed by the Collector, Raigarh against the petitioner (Annexure P-1), against such order the departmental appeal has been preferred before the Commissioner under Section 23 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966.

3. It is contended at para 8.18 of the petition that the departmental appeal has already been preferred, therefore, I am not inclined to go into the merits of this case. If the appeal is decided in favour of the petitioner then in such case there would be no necessity to adjudicate the facts and grounds raised in this petition. Under the circumstances, the Commissioner Bilaspur Division, Bilaspur is directed to hear the appeal which is preferred by the petitioner and decide the same within a further period of three months from the date of receipt of this order. It is further made clear that if the departmental appeal order goes against the petitioner, he shall be at liberty to prefer the petition before this Court.

4. At this stage, the petition is dismissed with the aforesaid liberty. Sd/- Goutam Bhaduri Judge Ashu
