The learned counsel appearing for the Petitioner submits that as given to understand the tender proceedings subjected to challenge in this writ petition have already been cancelled by the Municipality and in the said circumstance, the matter has become infructuous.

The factual position is conceded as correct by the learned counsel for the Respondent-Municipal Corporation as well, pointing out that, after cancellation of tender under challenge, a fresh tender has already been floated and bids have been received, which is being proceeded accordingly.

In the said circumstance, nothing remains to be considered. The writ petition is dismissed as infructuous.
