Justice Vimla Singh Kapoor, Order on Board by Justice Manindra Mohan Shrivastava, J. 02.03.2021 Heard on prayer for grant of leave to appeal. Taking into consideration the submission of learned State counsel that though the prosecution led clinching circumstantial evidence that the deceased, appellant's brother died homicidal death in his own house and at that time only appellant was at home and other members of the family were not in the house and recovery of blood stained club and blood stained cloths of the accused has been proved, acquittal has been granted, we are inclined to grant leave to appeal. Accordingly, CRMP is allowed. Let appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.
