Challenge in the present writ petition is to the notification dated 12.7.2019 (Annexure P-1) demarcating and determining the number of wards at Nagar Panchayat, Gunderdehi.

The said notification was published in July, 2019 and the writ petition now is being filed after about six months on 5.12.2019. In between, the development that has transpired is the issuance of the notification for the local election, that was done on 25.11.2019.

In the light of the subsequent development that the election program also being notified, this Court is of the opinion that it would not be proper at this stage to interfere with the determination of the wards by the respondents. The petitioner ought to have approached the Court at the appropriate time or at-least within a reasonable time well before the election program was notified. 4.
