1. The case of the petitioner is that the petitioner was removed from the services because of the criminal case No. 390/2011 which was pending against him under section 379, 420, 467, 468, 120-B/34 of IPC.However, he was acquitted on 29.05.2018. by Judicial Magistrate First Class, subsequent the judgment of acquittal the petitioner made repeated representation to grant him rejoining to the services but no decision has been taken. He refers to the judgment (Annexure P-3). He further submits that similar issue has been decided in WPS No. 6397 of 2019 on 26.08.2019.
2. Learned State counsel do not dispute the fact brought to the notice of the
Court that similar ratio has been decided by the Court in WPS No. 6397 of 2019.
3. Considering the nature of the dispute and acquittal has been effected, the petitioner is given liberty to file a fresh representation before Respondent No.2 within 3 weeks from today. The same having been filled shall be decided by Respondent No.2 in accordance with law within 90 days from the date of receipt of a copy of this order
