This is the second bail application. The first bail application of the applicant was rejected on merits by this Court vide order dated 17.01.2019 passed in M.Cr.C. No.7473/2018 considering prima facie case against him.

Counsel for the applicant submits that the applicant seeks permission of this Court to withdraw the second bail application. She further submits that the trial Court may be directed to expedite the trial and dispose of case as soon as possible.

As per enclosed photo copy of order sheets, which are the part of bail application, it appears that in the case in hand only Investigating Officer Mr. Sandeep Chandrakar is to be examined. 4.

Accordingly, the second bail application is dismissed as withdrawn. However, the trial Court is directed to expedite the trial and dispose of the case as soon as possible preferably within a period of two months from the date of receipt of certified copy of this order. 5.

Registrar (Judicial) is directed to send the copy of this order to the

concerned Court immediately.

The trial Court is directed to take all the suitable steps to ensure the attendance of Investigating Officer Mr. Sandeep Chandrakar. It appears from the said order sheets that the trial Court has not taken any action against the erring officer, who failed to serve the summon/bailable warrant to the Investigating Officer.
