2) Learned counsel for petitioners submits that Contemnor Mr. Ayodhya Prasad Soni, Regional Manager is taking coercive steps to remove the petitioners as through letter dated

22/11/2019 contemnor has directed all the Branch Manager of Chhattisgarh Rajya Gramin Bank Regional Office Baikunthpur to submit particulars of the daily wages employees who shall be paid wages by Anil Placement Agency, Ambikapur. This itself shows that the contemnor is acting in violation of the order dated 31/05/2019 passed by this Court which amounts to contempt of Court. He further submits that the W.P.(S) No. 4093/2019 was not listed alongwith connected matter W.P.(S) No. 4303/2019 filed by similar situated persons and therefore the same could not be heard by the Co-ordinate Bench and as such the interim relief could not be continued.

3) Heard counsel for the petitioners and perused the material available on record.

4) Looking to the submission of learned counsel for the petitioners it appears that only certain information is being collected by Chhattisgarh Rajya Gramin Bank in respect of the daily wages employees working in its different Branch and as such it cannot be said that any coercive step is being taken against the petitioners by the contemnor amounting to breach of order dated 31/05/2019 passed by this Court. From the record it is seen that after passing of order dated 31/05/2019 in W.P. No. 4092/2019, it was further listed for hearing before Co-ordinate Bench on 24/06/2019 when it was directed to be listed on 24/10/2019 without extending the interim order granted earlier. As such the interim order passed on 31/05/2019 which was to remain in effect only till next date of hearing, lost its further efficacy for want of extension on 24/06/2019.

5) Thus, in the given facts and circumstances of the case, no contempt as alleged by the petitioners can be said to have been committed by the contemnor. Accordingly, the contempt petition being without any substance is liable to be dismissed at the admission stage itself and is hereby dismissed. -Sd/- (Gautam Chourdiya) Judge Chandrakant
