Challenge in the present writ petition is to the order dated 3.12.2019 (Annexure P-1) terminating the agreement with the Petitioner for supply of ready to eat food.

The plain perusal of the impugned order would show that the order has already come into force for more than two weeks now. The order reflects that the authorities themselves have indicated the Petitioner that in case the Petitioner is aggrieved they should prefer a first appeal before the concerned District Collector. 3.

Given the fact that there is a remedy available to the Petitioner which they have not availed promptly, it would not be proper for this Court at this juncture to entertain the present writ petition.

Accordingly, reserving the right of the Petitioner to approach the concerned District Collector within a period of seven days from today, the Collector is directed to consider and decide the appeal at the earliest, preferably within a period of thirty days from the date of receipt of the appeal of the Petitioner. The Petitioner would also be at liberty to move an application for grant of interim relief before the Collector.
