Shri Ghanshyam Patel, Advocate for the respondent No.1. Shri Pankaj Agrawal, Advocate for the respondent No.2. The present contempt petition has been filed alleging willful disobedience of the order dated 19.08.2019 passed in WPS No.6158 of 2019.

The respondent have entered appearance and have produced a document Annexure R/1, dated 22.02.2020, whereby the respondents have rejected the request of the petitioner for absorption on the ground that the post on which the petitioner was working under the respondents was a post 100 percent to be filled up by promotion and that there was no provision for filling up of the said post by way of absorption, and therefore the claim of the petitioner can not be granted. In view of the said decision of the respondents, this court is of the opinion that the order dated 19.08.2019 passed by this court stands complied with. However, in case, if the petitioner is still aggrieved by the subsequent decision, the same would have to be challenged by way of a fresh writ petition.

Reserving the right of the petitioner for challenging the same, if they so want, the contempt petition stands disposed of. Sd/- (P. Sam Koshy) Judge Inder
