1. The relief sought by the petitioner in the present writ petition is for issuance of an appropriate direction to the respondent no.1 to take a decision on the application filed by the petitioner.

2. At the outset, this Court is not inclined to entertain the writ petition for

the simple reason that the dispute of the petitioner seems to be a simple property dispute and for resolution of such a dispute, the only recourse available is to prefer an appropriate suit before the concerned Civil Court. The nature of dispute between the petitioner and the private respondents is not one which can be decided in exercise of the writ jurisdiction of this Court under Article 226 of the Constitution of India.

3. Reserving the right of the petitioner to avail other remedies available under law, the present writ petition stands dismissed. Sd/- P. Sam Koshy Judge Khatai
