2. The grievance of the petitioner is that the petitioner who is working as Assistant Teacher at Government Pre Middle School Benjora has been transferred to Government Middle School Mahuadih, Farsabahar, District Jashpur, which is 100 KM away and there is no means of transportation to reach to the place of posting, therefore, it is prayed that the transfer order may be canceled and further it is prayed that the opportunity may be given to the petitioner to make a representation, which may be directed to be decided.

3. Perusal of the transfer order would show that it is dated 12.07.2019 and already 5 months have passed from the date of transfer, therefore, at this stage unless

and until the grounds are made out to show that the transfer order is tainted with malafide or illegal, the transfer being the incident of service, the same cannot be interfered. Therefore, I do not find any reason to interfere in such order of transfer. However, the petitioner shall be at liberty to make a representation before the respondent No.2 within a period of 4 weeks and on such representation being filed, the respondent No.2 shall decide the same in accordance with law.
