At the very outset, Ms Diksha Gouraha, learned counsel appearing for the petitioner, would submit that due to urgency for the fact that today is the last date for submission of application form pursuant to the impugned advertisement inviting applications for the post of Assistant Professor, she is not pressing para 10.1 of the

relief clause, which pertains to challenge to the constitutional validity of the condition prescribed in serial no.03 Schedule III of the Rule 8 (II) of the Chattisgarh Educational (Collegiate Branch Gazetted) Recruitment Rules, 2019 (henceforth 'the Rules, 2019'), for the present.

Ms Diksha Gouraha, learned counsel would next submit that the petitioner may be permitted to appear in the selection process on the strength of present qualification of the petitioner and for that she may be permitted to move before Her Excellency the Governor of Chattisgarh invoking the Governor's power under Rules 22 of the Rules, 2019.

While dismissing some other writ petitions pertaining to the same advertisement, this Court in WPS 3595 of 2019 and other connected matters by order dated 22-7-2019 has reserved liberty in favour of the petitioners therein to invoke the above referred relaxation clause.

Accordingly, the present writ petition is disposed of with liberty the petitioner to move before Her Excellency the Governor of Chhattisgarh, if she is eligible to get the benefit of Rule 22 of the Rules, 2019.
