1. The grievance raised in this writ petition is that the petitioner is a regular Class IV employee of respondent no.1 and because of certain ailment he could not join his duties for a specific period of time as he was undergoing the medical treatment. Thereafter, the petitioner was issued a detailed letter dated 04.02.2019 for the unauthorised absence wherein he was asked to file reply. The reply has been field by the petitioner on 05.02.2019 alongwith medical documents. However, the same has not been decided.

Learned counsel for the petitioner submits that because of the fact that the petitioner is not permitted to join and perform his duties, the respondents may be directed to consider the case of the petitioner sympathetically. It is submitted that he could not discharge the job due to medical ailment and proceeded on medical leave.

3. A perusal of the record would show that certain medical prescriptions, test reports of various medical centers/doctors and medical leave certificates have been attached to the petition. The petitioner was served with a show cause notice dated 04.02.2019.

4. Taking into consideration such facts, it is directed that respondent no.1 shall decide the case of the petitioner after considering the entire documents including the medical records of the petitioner's ailment within a period of 60 days from the date of receipt of this order. It is also open to the petitioner to place all the medical documents/certificates test reports etc., before respondent no.1 in support of his case.
