Mr. C.Jayant K. Rao, Advocate For State/Respondents :
Ms. Richa Shukla, Dy. Govt. Advocate Hon'ble Shri Justice Goutam Bhaduri Order on Board 03.01.2020 Heard
1. The only grievance of the petitioner is that the petitioner pursuant to the advertisement participated in the selection process for appointment and she secured merit list for the post of English Language & Communication Skill and the merit list was published by the respondent No.3, Shaheed Veer Narayan Govt. Industrial Training Institute, Asnind Kasdole, District Baloda Bazar-Bhatapara. It is stated that though the said appointment was for a limited period, despite the publication of the merit list, the actual appointment has not been given effect to. It is stated that the petitioner has filed a representation before the respondent No.3, Principal of the Institute for issuance of appointment letter, however, the same has not been decided and if the same is being kept for time immemorial, the valuable right of the petitioner shall be affected.
2. Perused the documents. Prima facie it shows that the petitioner was selected after due process and she secured position in the merit list as per Annexure P-2. Considering the fact that the petitioner has already filed a representation for the reason that the appointment letter has not been issued, the representation made by the petitioner on 03.12.2019 requires to be decided so that the petitioner may note the actual place where she stands as of now. Consequently, the respondent No.3 is directed to decide the representation of the petitioner within a period of 30 days from the date of receipt of the copy of this order. The petitioner shall also be at liberty to file a fresh representation, if so advised.
3. With such observation, the petition stands finally disposed off. Sd/- (Goutam Bhaduri) Judge Ashok
