1. Heard.

2. The accused/applicant has moved this third bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during the trial as he is in cutody in connection with Crime No.23/2016 registered at PS- Ganj, Distt. -Raipur, Chhattisgarh for the offences punishable under Sections 420, 467, 468, 471, 120 -B of the Indian Penal Code, 1860.

3. The applicant's first bail application was rejected on merits by order dated 01.12.2018 passed in M.Cr.C No.8448/2018. Second application bearing M.Cr.C No.2852/2019 was dismissed as withdrawn on 13.08.2019 with liberty to file repeat application after obtaining certain observations by the trial Court on the documents placed on record in his support.

4. It is submitted that the learned trial Court has made an observation on the documents regarding which copy of the order-sheet has been filed.

5. Perusal of the order-sheet dated 01.11.2019 reveals that the learned court of CJM, Raipur has simply observed the documents filed by the applicant but has not made any comments on the same.

6. The liberty granted to the applicant in the earlier order for seeking observation of the learned trial Court was not limited to ocular observation only, therefore, the application is disposed off at the motion stage. The applicant is at liberty to make a prayer before the trial Court to observe and comment on the genuineness of the documents filed by the applicant before that Court.
