1. Pursuant to an advertisement, the petitioner has applied for the post of Lecturer (E & T) and participated in the examination as he possessed the qualification of M.Tech., and B.Ed.

2. The challenge in this petition is that the petitioner's candidature was rejected on the ground that he was holding the post-graduate decree of M.Tech., and not M.Sc.

3. The petitioner would contend that M.Tech., is a postgraduate degree therefore on that count, the rejection of candidature of Petitioner could not have been made.

4. Per contra, learned State counsel would submit that the M.Tech., is being considered as the postgraduate degree and as per the instructions received, opportunity of hearing would be given to the petitioner and other similarly situated persons before issuance of

final appointment orders.

5. In view of the submission that the M.Tech., is being considered as postgraduate degree, no further order can be passed at this moment. It is expected that the petitioner, as has been stated, would be given hearing if the candidature is rejected before issuance of final appointment order.
