The documents have been filed to remove Default No.1. Although, application for condonation of delay has not been filed but considering that the papers are available, we have heard learned State counsel on admission.

The Trial Court has acquitted the accused of the charges under Sections 307 & 323 of IPC.

The injured examined as PW-2 Bodhna has turned hostile and has not supported the prosecution at any stage of his examination. The other important witnesses have also turned hostile.

No case for grant of leave to appeal is made out. 5.

Accordingly, the CRMP is dismissed.
