1. On due consideration delay of 288 days occurred in filing of the Cr.M.P. is condoned. Accordingly, I.A. No.01, for condonation of delay is allowed.

2. The trial Court has acquitted the accused of the charges under Sections 294, 506 Part-II, 436 of the I.P.C.

3. Accused committed mischief by fire by setting ablaze his own house but in the process causing damage to the

CRMP No. 117 of 2020 adjoining house belonging to his father-in-law.

4. All the witnesses are the relatives of the accused. They have turned hostile and have not supported the case of prosecution at any stage of their examination, therefore, there is no evidence that it was the accused who committed mischief by fire.

5. No case for grant of leave to appeal is made out.

6. Accordingly, the Cr.M.P. deserves to be and is hereby dismissed.
