Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/08/2020 This is an application for grant of anticipatory bail. At the outset, learned counsel for the applicant would submit that in view of subsequent events that co-accused has been tried and acquitted, the applicant intends to surrender for grant of regular bail. It is submitted that in these circumstances, when the co-accused has been acquitted, the Court below may be directed to consider his regular bail application on the same day.

Considering the submission, this bail application is dismissed as withdrawn with liberty to file regular bail application after surrender. In case, the applicant moves regular bail application before the Court below after surrender, the same shall be decided as early as possible, preferably within three days.
