1. Heard on application for condonation of delay as well as on prayer for grant of leave to appeal.

2. Even if, we are inclined to condone the delay, we do not find any merit in the case because learned trial Court has ordered acquittal as there is no evidence to involve the accused that he assaulted the victim as even the victim in his evidence, has not involved the accused and stated that he sustained injury due to fall, therefore, no exception can be taken to the judgment of acquittal. Therefore, the application is rejected.

3. The CRMP is accordingly dismissed.
