Matter taken up today as 25.11.2025 was declared a holiday on account of Guru Teg Bahadur's Martyrdom Day.

The petitioner/counterclaimant has assailed dismissal of amendment application. Broadly speaking, the counterclaim was filed by a proprietorship concern but the amendment application was filed by private limited company, so the amendment was declined. Besides, the learned trial court also took a view that since the proprietorship concern was not a party to the suit, it could not have filed a Written Statement-cum-counterclaim and accordingly, the counterclaim was rejected. According to learned counsel for petitioner/counterclaimant, the rejection of counterclaim is assailable by way of an appeal.

The present petition assails only the dismissal of amendment application and since as on date, the counterclaim itself stands rejected, the present petition cannot survive.
Therefore, learned counsel for petitioner/counterclaimant, on instructions, seeks permission to withdraw this petition.

Accordingly, the petition and the accompanying applications are dismissed as withdrawn.
