O R D E R

The present petition under Article 226 of the Constitution of India read with Section 482 of the Cr.P.C. seeks the following prayers:- "IN LIGHT OF THE ABOVE MENTIONED FACTS AND CIRCUMSTANCES, IT IS MOST RESPECTFULLY PRAYED THAT, THIS HON'BLE COURT MAY KINDLY BE PLEASED TO: - A. Issue a writ in the nature of mandamus directing the respondent to release petitioner on parole for a period of thirty days in FIR No. 447/2012, registered at Police Station: - Sangam Vihar, Delhi under Section 302/34 IPC.

B. That considering the presence of the petitioner is required to perform certain rituals on 04.01.2023, the petitioner be released immediately from the custody and police verification/any other formality as directed by this Hon'ble Court be complied with simultaneous/parallel to the release of the Petitioner. C. Pass any other or further order/directions as may deem fit in the facts and circumstances in the interest of justice." Status report dated 04.01.2024 authored by Station House officer, Police Station Sangam Vihar, South District, New Delhi has been handed up in Court and the same is taken on record. The factum of death of petitioner's father has been verified in the aforesaid status report. 3.

As per the nominal roll received, the petitioner had been granted parole and furlough and on each occasion had duly surrendered without misusing the liberty granted to him.

In this view of the facts and circumstances, the present petition is partly allowed. The petitioner is granted parole for a period of ten days from the date of his release, subject to the following conditions:- i. The petitioner shall furnish a personal bond in the sum of Rs. 25,000/- with two sureties of the like amount, to the satisfaction of the Jail Superintendent.

ii.

The memo of parties reflects that the petitioner resides at H.No. 1810, Gali No.19, Sangam Vihar, Delhi. In case of any change of address, the petitioner is directed to inform the same to the Jail Superintendent.

iii. The petitioner shall furnish a telephone number to the Jail Superintendent on which he can he contacted, if required. After his release, he shall also inform his telephone number to the SHO of the police station concerned.

iv. Immediately upon the expiry of period of parole, the petitioner shall surrender before the Jail Superintendent. v. The period of parole shall be counted from the day when the petitioner is released from jail.
