The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), seeking issuance of a direction in the nature of Habeas Corpus, directing the respondents to produce the wife of the petitioner, Ms. Nikita Saha, before the Court The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and to have her custody handed over to the petitioner. 3.

The wife of the petitioner is present in person before this Court. She states that due to mental and physical torture by the petitioner, she is not willing to reside with the petitioner for the present. She has, in fact, also filed a complaint with the Crime Against Women Cell, Shahdara District, Delhi.

A Status Report dated 05.01.2026 confirming the said fact has also been handed over by the learned counsel for the respondent no.1 in the Court today. Let the same be taken on record. 5.

Keeping in view the above, no further orders are required in this petition. The same is, accordingly, disposed of, with liberty to the parties to avail of their remedies in accordance with law.
