The present application under Section 439 of the Cr.P.C. seeks interim bail for a period of six weeks in case FIR No. 96/2020, under Sections 21/25/29 of the NDPS Act and Sections 468/471 of the IPC registered at P.S. Crime Branch on the ground that applicant's wife has to undergo surgery for disc at Mehta Hospital, New Delhi. 2.
The aforesaid fact has been verified in the Status report dated 04.01.2024 authored by Arvind Kumar, Inspector of Police, AGS/Crime Branch.

It is pointed out that previously vide orders dated 26.04.2023 and 12.09.2023 in BAIL APPLN. 176/2023 and BAIL APPLN. 2977/2023 respectively, the present applicant has been granted interim bail by predecessor bench of this Court on similar grounds. It is submitted that the applicant did not misuse the indulgence granted and duly surrendered. In view of the above, the present application is partly allowed. The applicant is directed to be released on interim bail for a period of two weeks from the date of his release, on his furnishing a personal bond of Rs. 1,00,000/- with two sureties of like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to following conditions: i.
The applicant is directed to give his mobile number to the Investigating Officer and keep it operational at all times. ii.
The applicant shall not leave NCT of Delhi without prior permission of the learned Trial Court.
iii.
The applicant shall inform the Investigating Officer after the surgery has been conducted on his wife.
iv.
The applicant shall duly surrender before the concerned jail authorities after expiry of his interim bail. 5.
The application is partly allowed and disposed of accordingly. 6.
Pending application, if any, also stand disposed of. 7.
Needless to state that nothing stated hereinabove is an opinion on the merits of the case.

Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.
