The instant petition under Section 482 of the Code of Criminal Procedure, 1973 has been filed by the petitioners praying for quashing of FIR bearing No.57/2019 registered at Police Station Madhu Vihar, Delhi for offences punishable under Sections 279/337/338 of the Indian Penal Code, 1860 (IPC).

Issue notice. Mr. Naresh Kumar Chahar, learned APP accepts notice on behalf of the State.

took place between the petitioner and respondent no.2 and the respondent no.2 sustained injuries due to the accident and on 29.03.2019, the respondent no.2 gave complaint to the police station Madhu Vihar and the present FIR was lodged.

Both the parties present before the Court submitted that they have amicably settled their disputes before the Lok Adalat and they have no grievance against each other.

Petitioner is present before this Court and has been identified by his counsel Mr. Sunil Kumar and Investigating Officer (IO) SI Krantiveer Singh from Police Station Madhu Vihar, Delhi.

On a query made by this Court, respondent no.2 who has been identified by the IO, was specifically asked as to whether he has received any amount. He says that he does not want any money as he has received compensation by way of an award before MACT. He wants to put an end to the litigation.

In view of the above facts that the parties have amicably resolved their disputes out of their own free will and without any coercion, the court is of the opinion that no useful purpose will be served by continuing the proceedings. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIR in question. 8.

Accordingly, FIR bearing No.57/2019 registered at Police Station Madhu Vihar, Delhi for offences punishable under Sections 279/337/338 of the IPC and all consequential proceedings emanating therefrom are quashed. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
