Broadly speaking, the order impugned is the one passed under Section 127 CrPC, whereby holding the salary of the husband to be Rs. 19,163/- per month as conductor, the trial court enhanced the maintenance of son of the parties from Rs. 5,500/- per month to Rs. 6,500/- per month. So far as maintenance of wife is concerned, the same was declined vide order dated 16.11.2017 on account of her having concealed facts about her business and income and the said order dated 16.11.2017 has not been challenged. Besides, the wife was also declined maintenance as she refused to comply with the decree dated 02.09.2020 for restitution of conjugal rights. 3.

So far as the husband is concerned, he has filed the CRL.REV.P.20/2024 to challenge order dated 21.12.2023 of the Family Court whereby his application for interim custody of the child was dismissed. The predecessor bench on the very first date called upon both sides to address on maintainability of interim custody application in proceedings under Section 125 CrPC and the matter is at that stage till date. Today, learned counsel for husband, after part arguments seeks permission to withdraw CRL.REV.P.20/2024 with liberty to initiate appropriate legal proceedings in accordance with law. Accordingly, CRL.REV.P.20/2024 is dismissed as withdrawn with liberty as sought. 4.
