% 05.01.2016 The petitioner is aggrieved by the comments of the Colonel Records dated 22.10.2015 which state that it had finally determined the grievance articulated in the statutory complaint dated 05.09.2015. Facially, the said communication is not a final order and are merely comments or recommendations which are to be looked into before a final decision is taken and communicated under Section 26(5) of the Army Act, 1950.

The respondents would take into consideration not only these comments but also other relevant factors/records and communicate the decision on the statutory complaint in accordance with law. The

writ petition is accordingly disposed of.
