This is an application filed by the Petitioner Vijay @ Vijay Kumar s/o Lt. Sh. Pramod Kumar Tomar under Section 439 Cr.P.C. seeking extension of interim bail granted on 12.12.2023 in case FIR No.30/2021 dated 01.02.2021 registered under Sections 377/419/364A/347/120B IPC read with Sections 25/27 of Arms Act, 1959 at P.S. Darya Ganj. 4.

Father of the Petitioner had expired on 28.11.2023. Interim bail was granted to the Petitioner on 12.12.2023 in BAIL APPLN. 4138/2023, for a period of three weeks for performing certain ceremonies as the eldest son in the family. ritual, i.e. Antyeshti Ceremony (Pind-Daan) is to be performed on 16.01.2024 at Haridwar and Petitioner being the eldest son is required to perform the ritual.

Learned APP accepts notice on behalf of the State. 7.

Factum of performance of Antyeshti Ceremony was not disputed in the status report filed by the State in the earlier bail application. Learned APP candidly does not dispute this fact even today, on instructions. Accordingly, interim bail granted to the Petitioner vide order dated 12.12.2023, which is to expire on 08.01.2024, is hereby extended for a further period of three weeks from 08.01.2024, subject to all the conditions enumerated in paragraph 6 of the order dated 12.12.2023. 8.

Needless to state that the Petitioner shall surrender before the Jail Authorities upon expiry of the period of extended interim bail and it is also made clear that no further extension shall be granted on this ground. 9.

Application stands disposed of in the aforesaid terms. 10.

Copy of the order be sent to the concerned Jail Superintendent for information and necessary compliance.
