Petitioner had been defending a suit for partition and by virtue of the present petition he challenges one order dated 02.11.2023 whereby his one application moved under Section 151 CPC has been dismissed. 2.

It has now been informed by learned counsel for petitioner that suit in question has already been decreed and said decree has been challenged by the petitioner herein. He submits that in terms of Section 105 CPC, he would challenge the order, which is impugned herein, in the aforesaid appeal and, therefore, does not press the present petition. 3.

The present petition is disposed of as not pressed in aforesaid terms. 4.
