The petitioner Bank has filed the present petition praying for setting aside the orders dated 19.09.2015 and 17.11.2015 passed in Suit No.314/2014.

The grievance of the petitioner is that at the time of filing the suit, alongwith the documents second page of the legal notice could not be placed on record and application was filed before the learned Trial Court to supplement the page which inadvertently could not be filed earlier. 3.

The grievance of the petitioner is further that the learned Trial Court has insisted for presence of the employee of the petitioner Bank, who issued the notice, for that purpose.

Learned counsel for the petitioner submits that since the stage before the learned Trial Court was only to place on record the deficient page, he may be permitted to avail his remedy before the learned Trial Court by moving appropriate application.

Accordingly, the petition is dismissed as withdrawn granting the liberty as prayed for.

A copy of this order be given dasti to learned counsel for the petitioner, as prayed.
