O R D E R

% 13.03.2020 On the last date of hearing, the notice of the petition was issued limited to the question of grant of some reasonable time to the petitioner to vacate the premises. Today, during the course of hearing, Mr. Singhal, ld. counsel for the respondent submits that he has instructions to state that six months' time may be granted to the petitioner to vacate and handover peaceful vacant possession of the premises subject matter of the petition and for such indulgence granted to the petitioner, the respondent does not press for any mesne profit/damages but for the amount being paid by the petitioner towards rent besides the payment of due water and electricity charges till the time the petitioner hands over the peaceful vacant possession to the respondent. Ld. counsel for the respondent on instructions agrees thereto.

Subject to the petitioner filing an undertaking in the foregoing terms

by way of an affidavit within two weeks from today, the execution of the impugned eviction order shall remain stayed for six months from today. Any arrears of the dues so falling due and payable to the respondent till now shall be cleared by the petitioner within four weeks from today and the dues for the successive months shall be cleared by 5th day of each successive months.
