% 15.03.2018 CS(COMM) 2/2018 & I.A.Nos.65/2018, 69/2018 Learned counsel for the plaintiffs states that as the India-South Africa cricket series has concluded, the present suit has become infructuous. Accordingly, the suit and applications stand disposed of as having become infructuous.
I.A.No.2169/2018 In the present application filed under Order XXXIX Rule 2A CPC, it is stated that defendant no.85 did not allow the Local Commissioner to enter its premises. It is further averred that despite
knowledge of the injunction order, the said defendant still broadcast the matches without obtaining any license/permission from the plaintiffs.
At this stage, learned counsel for defendant no.85, on instructions of defendant no.85 who is personally present in Court, tenders an unconditional and unqualified apology. She states that the said defendant shall pay Rs.5 lakhs to the Lok Nayak Hospital, New Delhi, within a period of four weeks.
The apology and offer of payment by counsel for defendant no.85 is accepted by this Court and the said defendant is directed to be more careful in future. Let the receipt of cost be filed within a period of one week thereafter.
