This is a petition seeking writ of mandamus directing the respondent for confinement of the petitioner in semi-open prison in FIR No. 421/2012 registered under Sections 302/324 of IPC at PS SP Badli. 2.

Mr. Yadav, learned counsel appears for the petitioner and states that the petitioner is serving sentence of life imprisonment and has already undergone 12 years of incarceration, hence, petitioner is eligible to be in semi-open prison.

Mr. Tyagi, learned ASC states that as per the jail records, the petitioner has undergone 4 years 1 month 4 days. To be eligible for semi-open prison, the convict needs to have undergone 5 years without remission. However, very fairly, he states that the present petition be treated as a representation to the jail authorities who shall verify the record and consider the same in accordance with law.

In this view of the matter, it is directed that the present petition be treated as a representation to the concerned jail authorities who shall decide the same in accordance with law expeditiously and in any case not later than 4 weeks from today.

In case the petitioner is still aggrieved, the petitioner shall be at liberty to file a fresh petition in accordance with law. 6.

Copy of this order be sent to the concerned Jail Superintendent for necessary compliance.
