The present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarika Suraksha Sanhita, 2023 has been filed seeking the following prayers: - "a) writ in the nature of mandamus or any other appropriate writ directing the respondent to grant first spell of furlough and release the petitioner for a period of 03 weeks in FIR no. 103/2006 PS: S.P.Badli, u/s 302/307/34 IPC and read with section 25/54/59 Arms Act b) Pass any such similar order/s as this Hon'ble court deem fit and proper in the interest justice."

Learned counsel for the petitioner submits that the latter has moved an application seeking furlough before the competent authority on 04.12.2024 owing to an emergency at his home for which his presence is required and since then, the said application is pending.

It is noted that the petitioner had moved an application seeking furlough on 04.12.2024 and the same is pending consideration before the competent authority.

In view of the aforesaid, the present petition is disposed of with a direction to the respondents to decide the aforesaid application filed by the petitioner within a period of 3 weeks from today. 9.

The present petition is disposed of alongwith all pending applications, if any, with the aforesaid direction.

Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.
