O R D E R

On the previous date, I had passed the order dated 7.1.2020. It is noticed that a typographical error has crept in paragraph Nos.2 and 3 of this order.

Instead of DRC, the acronym ERC should be mentioned. 3.

The order dated 7.1.2020 shall stand corrected to that limited extent.

As would be evident upon perusal of the order dated 7.1.2020, the limited issue which arises in the matter is whether the appeal committee should be called upon to consider the document appended on page 169 (annexure P-15) of the paper book. 5.

This document lends clarity to the building completion certificate which is appended on page 167 of the paper book. The clarification is issued as regards the measurements. 6.

As per annexure P-15, the measurements are in square metres W.P.(C) 35/2020 1/2

and not in square feet.

Mr. Amitesh Kumar also points out that annexure P-15 shows that the roofing is in RCC form and is not Asbestos Roofing. 8.

Having regard to the aforesaid, in my view, the appeal committee should reconsider the matter in line with the principle enunciated by this Court in judgment dated 20.12.2019 passed in W.P.(C) No.13542/2019, titled ABC College of Education and Anr. vs. National Council of Teacher and Anr.

Accordingly, the impugned order is set aside. The appeal committee will take into account annexure P-15 which is appended on page 169 of the paper book along with the document appended on page 167 and render a fresh decision in the matter. 10.

In case the appeal committee requires any further material, it will call upon the petitioner to furnish the same. 11.

Since I am told that the next meeting of the appeal committee is fixed in the last week of February 2020, the petitioner's matter will be taken up in that meeting.
