Learned counsel for the Appellant admits that in view of settlement arrived at between the parties before the Hon'ble Supreme Court, the present Appeal is rendered infructuous, however, he submits that as per the settlement, certain payments are to be made to the Appellant by the Respondent.

Admittedly, the matter is pending before the Hon'ble Supreme Court.

Hence, the present Appeal is disposed of with the observation that if the settlement fails, the Appellant shall have liberty to file application for revival of the present Appeal. ANIL KSHETARPAL, J.
