IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 26/2019 & CRL.M.A. 100/2019 PARICHAY SOOD & ANR ..... Petitioners Through Mr. Amit Biswas, Advocate versus STATE ( NCT OF DELHI ) & ORS ..... Respondents Through Mr. Raghuvinder Varma, APP for State with SI Deepak Kumar, P.S.

Malviya Nagar Mr.

Arun Mishra, Advocate for Respondent nos.2 and 3 along with respondent nos.2 and 3 in person

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 07.01.2019 It is submitted that disputes arose between the petitioners and private respondents in respect of a sale transaction of an immoveable property which led to the registration of FIR No. 353/2018 under Sections 406/420/120B IPC at police station Malviya Nagar against the petitioners, on the complaint of respondent no.2.

The petitioners and private respondents have now settled their disputes amicably vide Deed of Compromise/Settlement dated 17.12.2018, inasmuch as settled amount of `27,00,000/- has been paid to respondent nos. 2 and 3 by the petitioners in equal proportions.

Respondent nos. 2 and 3 are present in the court and have been

identified by SI Deepak Kumar of police station Malviya Nagar. They submit that they have settled the matter with the petitioners of their own free will and without any due coercion pressure, inasmuch as, have already received the settled amount. They say that they have no objection in case the aforesaid FIR is quashed. Affidavits of respondent nos. 2 and 3 are also on record to this effect.

Keeping in mind the settlement arrived at between petitioners and respondent nos. 2 and 3 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.

Dasti.
