The learned counsel for the appellants submit that after passing of the impugned order dated 12.12.2017 by the Court of learned Additional District Judge-13, Central District, Tis Hazari Courts, Delhi ('ADJ') in C.S. No.13018/2016, the suit was finally disposed of and the appellant has challenged the final judgment and decree vide RFA No.795/2018 in this Court.

In view of the above facts, the learned counsel for the appellants after making certain submissions, seeks permission to withdraw the appeal

with liberty to take the necessary plea in the RFA. 5.

The appeal along with applications being CM No.92/2019 and CM No.90/2019 is dismissed as withdrawn with such liberty. VINOD GOEL, J.
