Pursuant to the order dated 13.12.2019, the respondent appears in person and states that he has received a complete set of the paper book. The appellant has identified the respondent.

Learned counsel for the appellant states that the marriage of the parties was solemnized on 22.11.2011. It was a love marriage and there is no issue from the said marriage. Both the parties confirm that they have been living separately from July, 2013 onwards.

Learned counsel states that the appellant has filed the present appeal being aggrieved by the judgment dated 21.8.2019 passed by the learned Family Court dismissing a petition filed by her for dissolution of marriage with the respondent under Section 13 (1) (ia) of Hindu Marriage Act, 1955. MAT.APP.(F.C.) 324/2019

On enquiring from the respondent as to whether he is ready and willing to file a joint application for divorce by mutual consent before the Family Court, he states that he has no objection to the same. 5.

Accordingly, the present appeal is disposed of with liberty granted to the parties to jointly approach the Family Court by moving an application for divorce by mutual consent within one week from today. 6.

In the event either side has a second thought and decides not to go ahead for a divorce by mutual consent, then the appellant shall be entitled to approach this Court for revival of the present appeal. 7.
