O.M.P.(I) (COMM.) 448/2019 The present petition has been filed by the petitioner with the following prayers:
"In light of the above facts and circumstances it is humbly prayed that:
a) Restrain the respondent No.1, its directors, officers, agents, representatives, and / or employees from encashing
the B.G. No.4821ILG005116 b) Restrain respondent No.2 from paying out pursuant to any request from respondent No.1 under B.G.No.4821ILG005116.
c) Direct the respondent No.1 to withdraw its letter dated 04.12.2019 seeking encashment of the B.G.No.4821ILG005116.
d) ad-interim order in terms of prayer (a) (b) and (c) above e) Pass such other and further order / orders as may be deemed fit and proper in the facts and circumstances of the present case."
Ms. Ekta Khangawal, Adv., who appears for the respondent No.2 states that after invocation of the Bank Guarantee, the money has been remitted in favour of the beneficiary. She has drawn my attention to an e-mail dated December 06, 2019 in support of her contention and the same is taken on record.
In view of the fact that the money has been remitted to the beneficiary, learned counsel for the petitioner states that this petition has become infructuous and wishes to withdraw the same. The petition is dismissed as withdrawn.
