O R D E R

The present petition is filed seeking quashing of FIR No. 240/2023 dated 23.05.2023, registered at Police Station Baba Haridas Nagar, for offences under Sections 420/447 of the Indian Penal Code, 1860 ('IPC'). The FIR was registered on a complaint given by Respondent No. 2.

It is alleged that the mother of the complainant had purchased two plots of land bearing nos. 28 and 29 admeasuring 100 sq. yards being Khasra no. 133/10/2 and 133/10 situated in the revenue estate of village Dichaon Kalan ('subject properties'). It is alleged that after the demise of the mother of the complainant in February 2017, when the complainant visited the plot on 30.04.2023, he saw one pukka house constructed on one of the plots and a tin shed lying on the other plot. and stated that he had purchased the same from Petitioner Nos. 1 and 2. It is alleged that the petitioners in connivance with each other illegally grabbed the subject properties. The same culminated into the registration of the subject FIR. 3.

It is pointed out that a civil suit had also been filed in respect of the subject property.

The present petition has been filed on the ground that the parties have amicably settled all their disputes before the Mediation Centre, Dwarka Courts, New Delhi on 06.08.2024, of their own free will, without any coercion, pressure, undue influence, force, misrepresentation or mistake pursuant to which, the civil proceeding has also come to an end and a compromise decree has been passed.

The petitioners are present in person in Court and the complainant / Respondent No. 2 has joined the proceedings through video conferencing. The parties have been duly identified by the Investigating Officer.

On being asked, the complainant states that all the disputes between the parties have been settled. He submits that pursuant to the settlement, he has also received the possession of the subject properties. He further states that he does not wish to pursue any proceedings arising out of the present FIR and has no objection if the same are quashed.

Offences under Sections 420/447 of the IPC are compoundable in nature.

This Court is of the opinion that no useful purpose would be served by relegating the parties to the learned Trial Court for filing an application to compound the offences. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Keeping in view the nature of dispute and that the parties have amicably entered into a settlement, this Court feels that no useful purpose would be served by keeping the dispute alive and continuance of the proceedings would amount to abuse of the process of Court.

However, keeping in mind the fact that the State machinery has been put to motion, ends of justice would be served if the petitioners are put to cost.

In view of the above, FIR No. 240/2023 and all consequential proceedings arising therefrom are quashed, subject to payment of total cost of ₹20,000/- by the petitioners (approximately ₹6,667 by each petitioner) to be deposited with the Delhi Police Welfare Society within a period of eight weeks. 12.

Let the proof of deposit of cost be submitted to the concerned SHO.

The present petition is allowed in aforesaid terms. Pending application(s) also stand disposed of.
