By way of present petition filed under Section 439 (2) Cr.PC, petitioner seeks cancellation of bail granted to the accused Simram Choudhary @ Guru Seema Hazi @ Babloo/respondent No.2 vide order dated 20.09.2023 passed by the Ld. ASJ, Shahdara, Karkardooma Courts, Delhi, on the ground that after the grant of bail, witnesses have been threatened.

Notice is accepted by learned APP for State who states that the petitioner ought to have approached the Trial Court at the first instance seeking cancellation of bail. He further states upon instructions that two more FIRs have been registered against the accused. 4.

At this stage, learned counsel for the petitioner states, upon instructions, that he seeks leave to withdraw the present petition with liberty to approach the learned Trial Court at the first instance.
