Petitioner Sorab @ Sabba is facing trial for commission of offences under Sections 307/186/353/34 IPC and for offence under Section 25/27 Arms Act.

Incident in question is of 19.01.2023 when petitioner along with his co-accused Sameer Khan allegedly attempted to evade capture by firing at police team. He and his co-accused were, however, overpowered at the spot itself and the arrest also resulted in recovery of firearm and three live cartridges.

bail by the learned Trial Court on 02.02.2024. When petitioner prayed for grant of bail, his application was dismissed by the learned Trial Court, primarily, for the reason that he was having involvement in various other matters.

Case is already at the stage of prosecution evidence and out of nine cited witnesses, prosecution has examined two witnesses. 5.

Admittedly, even as per the case of prosecution, no one received injuries in the alleged incident when the police team was obstructed and prevented from discharging their official duties. Though, petitioner is having previous involvements, fact remains that according to him, he is on bail in all such matters, most of which pertain to theft. 6.

Accused is behind the bars since 19.01.2023.

Keeping in mind overall facts and circumstances of the case and without expressing any opinion on the merits of the case, petitioner/accused Sorab @ Sabba is admittedly to bail on his furnishing personal bond and surety bond in a sum of Rs. 30,000/- each subject to the satisfaction of concerned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class.

The application stands disposed of in aforesaid terms. 9.
